These Terms of Service (“Terms”) govern your use of chatspero.com and, if you become a customer, the Chatspero WhatsApp Business API platform (together, the “Service”). By using the website or submitting an enquiry, you agree to these Terms. If you are using the Service for a company, you confirm that you have authority to bind that company.
1. The Service
Chatspero is an official Meta Business Solution Provider. We provide tools for businesses to send WhatsApp campaigns, payment reminders, invoices, and related customer communication, and to view delivery and engagement status.
WhatsApp is operated by Meta. Message delivery, template approval, quality ratings, and conversation charges are controlled by Meta. We do not guarantee that Meta will approve a number, display name, or template, or that any given message will be delivered.
2. Eligibility
You must be able to form a binding contract and must use the Service only for a genuine business purpose. You must comply with applicable law and with Meta’s WhatsApp Business and Commerce policies.
3. Getting started
You can request access through the contact form on this website. We may accept or decline an enquiry at our discretion. Setup may require business verification, a WhatsApp Business API number, and approved templates. Timelines depend on Meta and on the information you provide.
4. Your account and content
You are responsible for activity under your account, for the accuracy of contacts and templates you upload, and for keeping login details confidential. You retain rights in your content. You grant Chatspero a licence to host and process that content solely to provide the Service.
You must have the right to contact each recipient and to use any name, invoice, offer, or other material you send. You must not use the Service to send spam, unlawful content, or messages that violate WhatsApp or Meta rules.
5. Acceptable use
You agree not to:
- Send bulk messages except through approved templates and permitted use cases.
- Mislead recipients about who is messaging them or why.
- Attempt to probe, overload, or bypass security of the Service.
- Resell the Service or use it on behalf of another business without our agreement.
- Upload malware or attempt to extract data that does not belong to you.
6. Fees
WhatsApp conversation charges are set by Meta and billed by category (for example marketing versus utility). Rates vary by country and can change. Service conversations inside Meta’s customer-care window are typically treated differently from marketing conversations.
Any Chatspero platform fees will be agreed with you before they apply. We do not guarantee specific Meta rates on this website. Unpaid amounts may result in suspension of access.
7. Availability
We aim to keep the website and platform available, but we do not warrant uninterrupted or error-free operation. Outages may result from maintenance, internet failures, or Meta / WhatsApp downtime. We are not liable for delay or failure caused by events beyond our reasonable control.
8. Intellectual property
The Chatspero name, logo, website design, and software are owned by us or our licensors. You may not copy, scrape, or reuse them except as needed to use the Service. Feedback you send may be used by us without obligation to you.
9. Privacy
Our Privacy Policy explains how we handle personal information. By using the Service you also agree to that policy.
10. Disclaimers
The website and Service are provided “as is”. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant specific business results such as payment collection, sales, or engagement rates.
11. Limitation of liability
To the fullest extent permitted by law, Chatspero is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost business, even if advised of the possibility.
Our total liability arising out of the Service is limited to the fees you paid us for the Service in the three months before the claim, or INR 10,000 if you have not paid platform fees. This cap does not apply where liability cannot be limited by law.
12. Indemnity
You will indemnify Chatspero against claims, losses, and costs arising from your content, your WhatsApp messaging, your violation of these Terms or Meta policies, or your infringement of another person’s rights.
13. Suspension and termination
We may suspend or end access if you breach these Terms, if Meta restricts the number or account, or if we are required to do so by law. You may stop using the website at any time. Provisions that should survive (including liability, indemnity, and IP) remain in effect.
14. Changes
We may update these Terms by posting a new version on this page. The “Last updated” date will change. If you continue to use the Service after a change, you accept the new Terms. If you do not agree, stop using the Service.
15. Governing law
These Terms are governed by the laws of India. Courts in India shall have exclusive jurisdiction, except where applicable law requires otherwise for consumers.
